Political Dissident from Iran Granted Refugee Status

Our client, a supporter of reformist presidential candidate Mir Hossein Mousavi, took part in the protests that followed the victory of Mahmoud Ahmedinejad in the stolen Iranian presidential election of July 2009. He was brutally beaten by the paramilitary Basij, and arrested and detained by Iranian intelligence (the Ettelaat). Fearing further persecution for his anti-government views, he was forced to flee Iran.

We advised and represented our client, preparing extensive submissions (based on legal arguments and country information) in his favour.

We argued that even though he was an ordinary person with no previous political profile, he would still face risks at the hands of the Iranian authorities; this argument was accepted.

We provided information from international observers to prove that his experiences in captivity were not atypical, but were consistent with international observers’ account of the torture and mistreatment to which Iranian dissidents are subjected; this argument was accepted.

We argued that, even though he was able to depart Iran safely, this did not detract from his credibility due to evidence indicating widespread bureaucratic inefficiency and corruption in Iran; this argument was accepted.

Our client’s refugee claim was successful, and he was granted a protection visa. He is just one of the many asylum seekers from Iran who we have successfully represented in their quest to seek protection in Australia.
